(Washington, D.C.): Americans United for Life (AUL) joined Advancing American Freedom on an amicus brief filed yesterday in Missouri v. FDA. 

While the Department of Justice argues that states lack the standing to sue the Food and Drug Administration (FDA) over harms to individual women by the abortion drug mifepristone, the brief outlines the legitimate interest of the states, recognized by the courts, in the safety of women and children residing in their borders. 

Carolyn McDonnell, Litigation Counsel for AUL, stated, “Chemical abortion drugs pose significant risks to women, including hemorrhage, sepsis, and death. Drug trafficking across state lines has compounded these risks, making the unsafe drugs even more dangerous, and enabling abusers to obtain the drugs to coerce women into having abortions. Pro-life states have standing to challenge the FDA’s removal of the in-person dispensing requirement, which permitted mail-order chemical abortions to the detriment of women’s health and safety.” 

Sarah Zagorski, Senior Director of Public Relations and Communications for AUL, added, “It is simply unacceptable that, while pro-life states have enacted laws to protect both mothers and their unborn babies, many women remain in harm’s way due to the Biden FDA’s careless deregulation. Sadly, the risk of harm has only increased as abortion pills can now be obtained with little to no oversight. With chemical abortion accounting for upwards of 60% of all abortions, the FDA has a responsibility to safeguard the lives of women and children.”
