(Washington, D.C.): Yesterday, the Department of Health and Human Services and the Centers for Medicare & Medicaid Services officially rescinded their guidance “Reinforcement of EMTALA Obligations specific to Patients who are Pregnant or Experiencing Pregnancy Loss.” Under this Biden-era abortion mandate, hospitals were required to offer abortion “care” should it be needed to stabilize a patient with emergent health conditions.
Rescinding this guidance, ridden with political motive, has been long overdue.
Americans United for Life originally filed an amicus brief for the case in the 5th Circuit Court as well as a separate brief on behalf of 121 members of Congress in a separate case before the U.S. Supreme Court. Just last month, AUL also filed an administrative comment asking for the Trump Administration to rescind the EMTALA abortion mandate.
Carolyn McDonnell, Litigation Counsel for AUL, stated, “EMTALA explicitly protects women in active labor and their unborn children. The rescission of the abortion mandate is a great victory for authentic women’s healthcare and the protection of unborn human life.”
AUL thanks the Trump Administration for rescinding this misguided abortion mandate and providing clarity to emergency medicine providers across the nation on how best to serve women and their unborn children.
