Washington, DC — Today, Americans United for Life filed a friend of the Court brief in the U.S. Supreme Court today on behalf of 228 Members of Congress in Dobbs v. Jackson Women’s Health, imploring the Court to uphold Mississippi’s right to protect preborn children and to overturn Roe v. Wade. Catherine Glenn Foster, President & CEO of Americans United for Life, released the following statement:
It is time for the national embarrassment of Roe v. Wade to be reversed and for justice to prevail for the human right to life. Today, 228 Members of Congress—44 Senators along with 184 Representatives—stand in solidarity with preborn Americans and their mothers. The leaders and people of Mississippi showed wisdom and compassion when they acted to protect preborn children at 15 weeks’ gestational age. Mississippi’s common-sense law is obviously constitutional. It is far past time for the U.S. Supreme Court to resolve the bitter culture war that it started, and has perpetuated, through its ill-conceived abortion rulings.
In Roe v. Wade, and in its deadly progeny Planned Parenthood v. Casey, the Court conjured constitutional fictions to justify the unjustifiable. The Court rejected the first and foundational human right to life. The Court condemned millions to death by abortion and a toxic culture of moral indifference. The Court, as Associate Justice Clarence Thomas has observed, “created the right to abortion,” and it is “a creation that should be undone.” The Court, through its abortion rulings, has done violence to the American way of life.
Today, the Court has the chance to set things right. The Court should acknowledge that peace, justice, and public order are incompatible with the violence and injustice of abortion. The Court can start by overruling Roe and Casey, relinquishing its control over these decisions to the American people and allowing their representatives to affirmatively and comprehensively protect life. The Court must ultimately restore the human right to life in our culture, law, and policy in the fullness of its scope and should reject wholesale any attempt to legitimize abortion or its perpetuation.
Since the legal fiction of Roe was imposed on the American people, countless millions of our brothers and sisters have been lost and untold numbers of mothers and fathers have been wounded and their trauma ignored or downplayed by abortion activists. Increasingly, the fabric of American life risks being rent asunder by a feverishly hot culture war that the Court alone has the power to stop. Every member of the human family is conceived with a future, and this Court owes it to every past victim and every future vulnerable member of the human family to restore the true promise of America by ending the horror of state-sanctioned abortion. It is time for the killing to stop. The Court must look to our Constitution, it must reverse Roe, and it must protect human life.
This effort on behalf of brave members of Congress was led by pro-life champions who galvanized hundreds of members to fight for life in the Court Including Senator Roger Wicker and Senator Cindy Hyde-Smith both of Mississippi. Senator Wicker said:
Mississippi is leading the charge in standing up for the most vulnerable in our society, Wicker said. This case represents the most significant challenge in a generation to Roe v. Wade, which has imposed abortion on demand across this country for nearly 50 years. I am proud to stand with Mississippi in this noble fight.
Mississippi Senator Cindy Hyde-Smith added:
In taking up Mississippi’s pro-life law, the Supreme Court has a chance to reconsider the current misguided abortion jurisprudence. As a Senator, as a woman, and as a mother, I think this case offers us a chance to overturn Roe and return the abortion issue to the political process and away from activist judges, Hyde-Smith said. I am thankful so many of my colleagues are standing with Mississippi and against unlimited abortion on demand in this case.
