In Roe v. Wade, Justice Harry Blackmun structured the argument of the majority around the history of abortion laws. The problem? Blackmun’s history simply doesn’t hold up—it didn’t at the time, and it doesn’t today.

Joseph W. Dellapenna, Professor of Law at Villanova University School of Law, literally wrote the book on the true history of abortion. Professor Dellapenna’s incredible 1,300 page book, “Dispelling the Myths of Abortion History,” takes the reader through the past, present, and future of abortion jurisprudence. Professor Dellapenna lays out how an unbroken tradition refutes the claims that falsely suggest that children in the womb have not been treated as persons in our law—or as persons under the Constitution of the United States.

Tom Shakely and Noah Brandt speak with Professor Joseph Dellapenna on the myths of abortion history, the true history of abortion in America, and Roe v. Wade and its future.
