(Washington, D.C.): This morning, Americans United for Life (AUL) joined a coalition led by Advancing American Freedom in urging the Department of Justice (DOJ) under General Blanche to review enforcing the Comstock Act’s mail-order abortion restrictions.
Under the Biden administration, the DOJ’s Office of Legal Counsel interpreted Comstock to not apply to the mailing of abortion pills under most circumstances. The coalition has asked the DOJ to review this interpretation and enforce Comstock according to the plain language, aligning with the intent with which it was passed by Congress.
John Mize, CEO of Americans United for Life, stated, “The Biden administration practically nullified an act of Congress when they bent the language of the Comstock Act to fit their pro-abortion agenda. Access to any drug should never be placed over women’s safety. AUL asks General Blanche to correct this errant interpretation of the act and finally enforce Comstock as Congress intended.”
Steven H. Aden, Chief Legal Officer & General Counsel for AUL, added, “Congress could not have been clearer when drafting the Comstock Act. Any drug or instrument mailed for the purpose of abortion, mifepristone or otherwise, cannot be sent through the mail. There is no contrary interpretation that can excuse the dangerous distribution of the abortion pill, and it’s time for the DOJ to enforce Comstock and protect women.”
