The only comprehensive listing of pro-life litigation publicly available, this report documents the status of major cases concerning Life across the country in federal and state courts. The goal of the report is to provide you with a useful resource, in addition to AUL’s expertise, on legal and policy issues affecting Life. Here are some highlights of the Report: 

Dobbs v. Jackson Women’s Health Organization

Oral arguments occurred before the Supreme Court in Dobbs v. Jackson Women’s Health Organization on December 1, 2021.  Dobbs is primed to discard the arbitrary viability line from Casey’s undue burden standard, and possibly overrule the purported abortion right the Supreme Court manufactured in Roe v. Wade. Notably, many lower courts are holding abortion cases in abeyance pending the Dobbs decision. 

Texas Heartbeat Act Remains In Effect After Supreme Court Challenge

The Supreme Court allowed Texas’ Heartbeat Act (S.B. 8) to remain in effect in Whole Woman’s Health v. Jackson and United States v. Texas. In Van Stean v. Texas Right to Life, however, a Texas state court determined S.B. 8 was unconstitutional because of its standing for uninjured persons, punishment without due process, and delegation of executive power to private persons. 

Additional Litigation Updates In Significant Pro-Life Cases

The Inter-American Court of Human Rights stripped away infant legal protections in Manuela v. El Salvador. The court ordered El Salvador to lower infanticide penalties and pass regulations prohibiting doctors from reporting potential infanticide cases. 

The Pennsylvania Supreme Court is considering whether the State must publicly fund abortions in Allegheny Reproductive Health Center v. Pennsylvania Department of Human Services. The abortion clinic has urged the court to craft a state constitutional right to abortion. 

A South Dakota anti-coercion statute directing women to receive neutral informed consent counseling from a state-approved registered pregnancy help center before obtaining an abortion is now before the Eighth Circuit in Planned Parenthood Minnesota, North Dakota, South Dakota v. Noem

Following a strong pro-life Sixth Circuit en banc decision, judgment was entered in favor of Tennessee’s forty-eight-hour reflection period law in Bristol Regional Women’s Center v. Slatery
