“Today the Alabama Supreme Court held that preborn children are protectable persons in the law under state law, continuing its construction of state criminal and tort law to include the protection of preborn children as persons. Justice Parker, in a specially concurring opinion, surveyed six areas of law that increasingly recognize the unborn child as a person with legally enforceable rights: criminal law, tort law, guardianship law, healthcare law, property law, and family law.
“Alabama’s Supreme Court holding and Justice Parker’s elucidation underscore that Roe v. Wade is truly an anomaly in American law that must be overturned in order for our system to maintain its legitimacy.
