Hadley Arkes returns to “Life, Liberty, and Law” with Tom Shakely and Noah Brandt to talk originalism, the U.S. Supreme Court under Chief Justice John Roberts, and the principles and moral sensibilities that lie beyond the Constitution’s text. David French and Josh Craddock have joined “Life, Liberty, and Law” previous to talk on originalism and textualism, and as the debate over the practical usefulness of originalism intensifies, Hadley contributes to this important conversation. Hadley also discusses the possibilities for pro-life law and policy in light of what appears to be a U.S. Supreme Court increasingly comfortable with (call it whatever you want) forms of judicial supremacy and judicial activism and the threat SCOTUS’s continuing evolution into a sort of super-legislature.
